I'm trying to copy and paste a selection from one .afphoto document to a new one with a transparent background, when I paste it into the new file, it doesn't paste in the middle so I have to move it.

The problem is that when I try to move the pasted layer, the entire background moves along with it, it doesn't matter if I copy normally or copy flattened. I don't understand why a normal visible background layer isn't created automatically when creating a new file.

In Photoshop this has never been as issue, how do I stop the background from moving with the layer?

I'm not sure I completely follow when you say 'the entire background moves' but assuming you're making the selection from a 'pixel' rather than an 'image' layer in your source document then once pasted in your destination file you should be able to freely move and position your pasted selection as you choose...

Let us know what you're doing differently and then I'm sure we can help further...
