Can’t select select text path via text, need to select actual path

I recall in a previous version it was relatively easy to select a text path by simply selecting the text. Now it seems it requires selecting precisely the actual path, otherwise layer in background becomes selected.

I've just tried this with a basic document and this seems to be working as expected. Would you be able to attach a document that exhibits this please?
