I haven't gotten an update email for Photo or Designer. But the apple app store says to do it. But when I try to update either program, I agree to the new conditions, but then get "We have a problem." 

Can I update a different way?

Hi EleanorMcC and Welcome to the Forums,

I'd suggest getting in touch with Apple about this issue, as it's an issue with App Store.  We don't have another way to get the update to people who brought Affinity via the Mac App Store.  Apple are normally very good at resolving issues with the App Store when contacted in my previous experience :)

That suggests you might be running a Mac OS version older than 10.9 Mavericks. If so, see this topic or the @Andy Somerfield reply it references here.

(Short version: update 1.7.1 due next week will fix this.)
