No check mark listed in the crop tool when I use it to finish my project.

There should be both a check mark and a cross on the Context toolbar (to confirm or cancel the operation) when the Crop Tool is selected. If that isn’t what you see, please post a screenshot.

You can merge the layers if you like (although you’d have to rasterize the ‘Image’ layer first) but there’s no need. When you export the finished project to JPEG, PNG or TIFF it will all be flattened anyway.
