What is happening is that at 21pt, there is enough space to fit the 1. text inside the set Tab Stop area. However at 22pt, there isn't quite enough space, so a tab stop is added. However at 22pt, the character doesn't fit in this area, so an additional tab stop space is added creating the gap. InDesign does the exact same thing.
