I think I understood how it happens.

1) you double click a picture in Publisher.

2) the "local" editor opens in a panel;

3) you close it, but in some way it remain locked to Publisher

4) the save of Photo fails, because the file has not been released by Publisher

Is it possible?

More details would be needed. For example, 

  1. In Publisher, was it an Embedded or Linked file?
  2. How did you get it open in Photo? When did you get it open in Photo (compared with when you used it in Publisher)?
    Double-clicking it in Publisher would only open it in a tab in Publisher, not in the Photo application.
