"Export Slices" not honring Adjustment Layer

I have a series of layers that I want to export as slices.

Above all the layers, I have an adjustment layer that changes the image from color to B&W.

However, when I export my slices, the B&W adjustment layer is ignored, and the slices are produced in color. 

 

What trick am I missing?

I know I can "merge down" on each layer, so the Adjustment Layer settings are baked into each slice. But I was hoping to keep the non-destructive feature that Adjustment Layers provide.

It works properly for me, but how do you export? Did you create a Slice using the Layers panel in Export Persona? In this case, you need to group the Adjustments layer and the source layer using Groups. Or use default/background slice?
